BC Rail and the Squamish Nation

The British Royal Proclamation of 1763 was designed to solve the problem of private transfers of Indian land in North America. It decreed that there were to be no sales of such land to individual settlers: instead, Indian land was to be surrendered to the Crown through a treaty process. In other words, the document confirms the existence of Aboriginal Title and Rights which only could be extinguished by means of a treaty

BY THE KING. A PROCLAMATION GEORGE R.


Whereas We have taken into Our Royal Consideration the extensive and valuable Acquisitions in America, secured to our Crown by the late Definitive Treaty of Peace, concluded at Paris. the 10th Day of February last; and being desirous that all Our loving Subjects, as well of our Kingdom as of our Colonies in America, may avail themselves with all convenient Speed, of the great Benefits and Advantages which must accrue therefrom to their Commerce, Manufactures, and Navigation, We have thought fit, with the Advice of our Privy Council. to issue this our Royal Proclamation, hereby to publish and declare to all our loving Subjects, that we have, with the Advice of our Said Privy Council, granted our Letters Patent, under our Great Seal of Great Britain, to erect, within the Countries and Islands ceded and confirmed to Us by the said Treaty, Four distinct and separate Governments, styled and called by the names of Quebec, East Florida, West Florida and Grenada, and limited and bounded as follows, viz.

First--The Government of Quebec bounded on the Labrador Coast by the River St. John, and from thence by a Line drawn from the Head of that River through the Lake St. John, to the South end of the Lake Nipissim; from whence the said Line, crossing the River St. Lawrence, and the Lake Champlain, in 45. Degrees of North Latitude, passes along the High Lands which divide the Rivers that empty themselves into the said River St. Lawrence from those which fall into the Sea; and also along the North Coast of the Baye des Chaleurs, and the Coast of the Gulph of St. Lawrence to Cape Rosieres, and from thence crossing the Mouth of the River St. Lawrence by the West End of the Island of Anticosti, terminates at the aforesaid River of St. John.

Secondly--The Government of East Florida. bounded to the Westward by the Gulph of Mexico and the Apalachicola River; to the Northward by a Line drawn from that part of the said River where the Chatahouchee and Flint Rivers meet, to the source of St. Mary's River. and by the course of the said River to the Atlantic Ocean; and to the Eastward and Southward by the Atlantic Ocean and the Gulph of Florida, including all Islands within Six Leagues of the Sea Coast.
Thirdly--The Government of West Florida. bounded to the Southward by the Gulph of Mexico. including all Islands within Six Leagues of the Coast. from the River Apalachicola to Lake Pontchartrain; to the Westward by the said Lake, the Lake Maurepas, and the River Mississippi; to the Northward by a Line drawn due East from that part of the River Mississippi which lies in 31 Degrees North Latitude. to the River Apalachicola or Chatahouchee; and to the Eastward by the said River.

Fourthly--The Government of Grenada, comprehending the Island of that name, together with the Grenadines, and the Islands of Dominico, St. Vincent's and Tobago. And to the end that the open and free Fishery of our Subjects may be extended to and carried on upon the Coast of Labrador, and the adjacent Islands. We have thought fit. with the advice of our said Privy Council to put all that Coast, from the River St. John's to Hudson's Streights, together with the Islands of Anticosti and Madelaine, and all other smaller Islands Iying upon the said Coast, under the care and Inspection of our Governor of Newfoundland.

We have also, with the advice of our Privy Council. thought fit to annex the Islands of St. John's and Cape Breton, or Isle Royale, with the lesser Islands adjacent thereto, to our Government of Nova Scotia.

We have also, with the advice of our Privy Council aforesaid, annexed to our Province of Georgia all the Lands Iying between the Rivers Alatamaha and St. Mary's.

And whereas it will greatly contribute to the speedy settling of our said new Governments, that our loving Subjects should be infomed of our Paternal care, for the security of the Liberties and Properties of those who are and shall become Inhabitants thereof, We have thought fit to publish and declare, by this Our Proclamation, that We have, in the Letters Patent under our Great Seal of Great Britain, by which the said Governments are constituted. given express Power and Direction to our Governors of our Said Colonies respectively, that so soon as the state and circumstances of the said Colonies will admit thereof, they shall, with the Advice and Consent of the Members of our Council, summon and call General Assemblies within the said Governments respectively, in such Manner and Form as is used and directed in those Colonies and Provinces in America which are under our immediate Government:

And We have also given Power to the said Governors, with the consent of our Said Councils, and the Representatives of the People so to be summoned as aforesaid, to make, constitute, and ordain Laws. Statutes, and Ordinances for the Public Peace, Welfare, and good Government of our said Colonies, and of the People and Inhabitants thereof, as near as may be agreeable to the Laws of England, and under such Regulations and Restrictions as are used in other Colonies;

and in the mean Time, and until such Assemblies can be called as aforesaid, all Persons Inhabiting in or resorting to our Said Colonies may confide in our Royal Protection for the Enjoyment of the Benefit of the Laws of our Realm of England;

for which Purpose We have given Power under our Great Seal to the Governors of our said Colonies respectively to erect and constitute, with the Advice of our said Councils respectively, Courts of Judicature and public Justice within our Said Colonies for hearing and determining all Causes, as well Criminal as Civil, according to Law and Equity, and as near as may be agreeable to the Laws of England, with Liberty to all Persons who may think themselves aggrieved by the Sentences of such Courts, in all Civil Cases. to appeal, under the usual Limitations and Restrictions, to Us in our Privy Council.

We have also thought fit, with the advice of our Privy Council as aforesaid, to give unto the Governors and Councils of our said Three new Colonies, upon the Continent full Power and Authority to settle and agree with the Inhabitants of our said new Colonies or with any other Persons who shall resort thereto, for such Lands. Tenements and Hereditaments, as are now or hereafter shall be in our Power to dispose of; and them to grant to any such Person or Persons upon such Terms, and under such moderate Quit-Rents, Services and Acknowledgments, as have been appointed and settled in our other Colonies, and under such other Conditions as shall appear to us to be necessary and expedient for the Advantage of the Grantees, and the Improvement and settlement of our said Colonies.

And Whereas, We are desirous, upon all occasions, to testify our Royal Sense and Approbation of the Conduct and bravery of the Officers and Soldiers of our Armies, and to reward the same, We do hereby command and impower our Governors of our said Three new Colonies, and all other our Governors of our several Provinces on the Continent of North America, to grant without Fee or Reward, to such reduced Officers as have served in North America during the late War, and to such Private Soldiers as have been or shall be disbanded in America, and are actually residing there, and shall personally apply for the same, the following Quantities of Lands, subject, at the Expiration of Ten Years, to the same Quit-Rents as other Lands are subject to in the Province within which they are granted, as also subject to the same Conditions of Cultivation and Improvement; viz.


To every Person having the Rank of a Field Officer--5,000 Acres.

To every Captain--3,000 Acres.

To every Subaltern or Staff Officer,--2,000 Acres.

To every Non-Commission Officer,--200 Acres .

To every Private Man--50 Acres.

We do likewise authorize and require the Governors and Commanders in Chief of all our said Colonies upon the Continent of North America to grant the like Quantities of Land, and upon the same conditions, to such reduced Officers of our Navy of like Rank as served on board our Ships of War in North America at the times of the Reduction of Louisbourg and Quebec in the late War, and who shall personally apply to our respective Governors for such Grants.

And whereas it is just and reasonable, and essential to our Interest, and the Security of our Colonies, that the several Nations or Tribes of Indians with whom We are connected, and who live under our Protection, should not be molested or disturbed in the Possession of such Parts of Our Dominions and Territories as, not having been ceded to or purchased by Us, are reserved to them. or any of them, as their Hunting Grounds.--We do therefore, with the Advice of our Privy Council, declare it to be our Royal Will and Pleasure. that no Governor or Commander in Chief in any of our Colonies of Quebec, East Florida. or West Florida, do presume, upon any Pretence whatever, to grant Warrants of Survey, or pass any Patents for Lands beyond the Bounds of their respective Governments. as described in their Commissions: as also that no Governor or Commander in Chief in any of our other Colonies or Plantations in America do presume for the present, and until our further Pleasure be known, to grant Warrants of Survey, or pass Patents for any Lands beyond the Heads or Sources of any of the Rivers which fall into the Atlantic Ocean from the West and North West, or upon any Lands whatever, which, not having been ceded to or purchased by Us as aforesaid, are reserved to the said Indians, or any of them.

And We do further declare it to be Our Royal Will and Pleasure, for the present as aforesaid, to reserve under our Sovereignty, Protection, and Dominion, for the use of the said Indians, all the Lands and Territories not included within the Limits of Our said Three new Governments, or within the Limits of the Territory granted to the Hudson's Bay Company, as also all the Lands and Territories lying to the Westward of the Sources of the Rivers which fall into the Sea from the West and North West as aforesaid.

And We do hereby strictly forbid, on Pain of our Displeasure, all our loving Subjects from making any Purchases or Settlements whatever, or taking Possession of any of the Lands above reserved. without our especial leave and Licence for that Purpose first obtained.

And. We do further strictly enjoin and require all Persons whatever who have either wilfully or inadvertently seated themselves upon any Lands within the Countries above described. or upon any other Lands which, not having been ceded to or purchased by Us, are still reserved to the said Indians as aforesaid, forthwith to remove themselves from such Settlements.

And whereas great Frauds and Abuses have been committed in purchasing Lands of the Indians, to the great Prejudice of our Interests. and to the great Dissatisfaction of the said Indians: In order, therefore, to prevent such Irregularities for the future, and to the end that the Indians may be convinced of our Justice and determined Resolution to remove all reasonable Cause of Discontent, We do. with the Advice of our Privy Council strictly enjoin and require. that no private Person do presume to make any purchase from the said Indians of any Lands reserved to the said Indians, within those parts of our Colonies where, We have thought proper to allow Settlement: but that. if at any Time any of the Said Indians should be inclined to dispose of the said Lands, the same shall be Purchased only for Us, in our Name, at some public Meeting or Assembly of the said Indians, to be held for that Purpose by the Governor or Commander in Chief of our Colony respectively within which they shall lie: and in case they shall lie within the limits of any Proprietary Government. they shall be purchased only for the Use and in the name of such Proprietaries, conformable to such Directions and Instructions as We or they shall think proper to give for that Purpose: And we do. by the Advice of our Privy Council, declare and enjoin, that the Trade with the said Indians shall be free and open to all our Subjects whatever. provided that every Person who may incline to Trade with the said Indians do take out a Licence for carrying on such Trade from the Governor or Commander in Chief of any of our Colonies respectively where such Person shall reside. and also give Security to observe such Regulations as We shall at any Time think fit. by ourselves or by our Commissaries to be appointed for this Purpose, to direct and appoint for the Benefit of the said Trade:


And we do hereby authorize, enjoin, and require the Governors and Commanders in Chief of all our Colonies respectively, as well those under Our immediate Government as those under the Government and Direction of Proprietaries, to grant such Licences without Fee or Reward, taking especial Care to insert therein a Condition, that such Licence shall be void, and the Security forfeited in case the Person to whom the same is granted shall refuse or neglect to observe such Regulations as We shall think proper to prescribc as aforesaid.

And we do further expressly conjoin and require all Officers whatever, as well Military as those Employed in the Management and Direction of Indian Affairs, within the Territories reserved as aforesaid for the use of the said Indians, to seize and apprehend all Persons whatever. who standing charged with Treason. Misprisions of Treason. Murders, or other Felonies or Misdemeanors. shall fly from Justice and take Refuge in the said Territory. and to send them under a proper guard to the Colony where the Crime was committed of which they, stand accused. in order to take their Trial for the same.

Given at our Court at St. James's the 7th Day of October 1763. in the Third Year of our Reign.

GOD SAVE THE KING

In 1936 the government transfered the Capilano Indian Reserve in North Vancouver to British Pacific Properties Ltd. which constructed the Lions Gate Bridge and other projects. The first English monarchs to come to Canada attended a ceremony for the new bridge in 1939 but they ignored Mary Capilano, the First Nations matriarch.


Within a short period after colonization, the traditional hunting and fishing grounds in what is now Greater Vancouver were destroyed by the combined forces of logging, mining, saw mills, fish canneries, urban sprawl and hydro dams. The Capilano Logging Company cleared most of the ancient forests of North Vancouver, leaving a vast wasteland of stumps that was slash burned in preparation for surveyors to subdivide (left).
Colonial land speculators who made a fortune from their illicit activities included the first attorney general and supreme court justice of the colony of BC, the first mayor of New Westminster; the first secretary of the treasury, the first Indian Superintendent, and so on. All got Indian land for cheap and sold it at great profit, setting up a model of exploitation that continues today


1850-1854
James Douglas, Governor of the colony of Vancouver Island, enters into 14 treaties (settlements involving reserve lands, compensation, etc.) on Vancouver Island, with various First Nations. After 1854, no further treaties signed as a result of dispute over who would bear the cost of such settlements (the colony, the Imperial government, or Hudson's Bay Co.).


And no other treaties were signed nor lands ceded until the Nisga Treaty in 2000.

Gas tax protest group numbers soar on Facebook

VANCOUVER - Axe The BC Gas Tax - an online Facebook protest group created by political commentator Bill Tieleman - has signed up nearly 7,500 members in less than 3 weeks to fight the new provincial gas tax to be imposed on July 1.

Tieleman says the Facebook protest group he created to oppose Premier Gordon Campbell's 2.4 cents per litre carbon tax on gasoline and other fuels has grown far beyond his wildest expectations since he proposed it in his weekly column in 24 hours newspaper on June 10.

"I am amazed at the incredible growth of the Axe The BC Gas Tax group on Facebook in such a short period of time," Tieleman says. "It clearly shows how strongly British Columbians feel that the new gas tax is unfair, unnecessary and unacceptable."[snip.....]

Dividend Arrived Today, and it is Invested

Well, here it is Tuesday June 24 2008, and my portion of the bribe offered up to me from Campbell arrived in the mail. He calls it a dividend. I ask "Is this a one time dividend?"

You see usually when a company (or government) makes a bunch of money for their shareholders they give dividends. As long as they make a piss pot full of money they keep giving dividends.

So I repeat "is this a one time thing while you are reaping billions off the backs of the common man, or will there be more.?"

I hope there will be more because I am about to tell you what I am going to do with this "windfall". I thought very long and hard over this.

As most people know that read the blogs (where I make comments) I am a pensioner. I am not yet 65 but I have two pensions. One is a UNION pension and it is fixed. The other is a Government Pension and it is indexed to the cost of living. But you see the government has a lot of creative beancounters and they have various ways of keeping the "cost of living" in check. When I get a cost of living increase in the government pension it only comes about 4 months after the actual cost has risen. So for 4 months the government keeps my money (and that of thousands of others) in the bank collecting interest. By the time we get it you could say that this increase was "revenue neutral". So it really doesn't cost the government anything.

So I thought to myself "What can I do to make the most of this money?" You know, the hundred buck bribe. And I came up with a good plan.

I'm going to take half that money and invest it in something that will save me approximately $50 this year. It probably won't save me near that next year due to the actual cost of living. But this year it should make my money "revenue neutral" to me.

Now I thought long and hard on the next saving. And the only way I can see that money work for me is to invest it in someone running for the provincial legislature. Anyone but a Liberal. You see any liberal that is elected will be dictated to by Gordon Campbell. And that is not a good thing. So my bet is that the NDP will repeal most of the bad legislation passed by this dictatorial government if elected. And if they don't repeal this farce they will at least act fast to impliment the "cap and Trade" or something similar that this government is (I alledge) unwilling to do. You see we need to make the playing field level.

So my choice of person to elect and support with my $50 is an NDP member. That should piss off Campbell real bad. You see he despises the NDP as much as anyone could despise anyone or anything.

So, Charlie Wyse, where can I send my money?

Clear Cutting CLBC and Welfare

A usually reliable source reports that after being appointed responsible for welfare, Rich Coleman was asked about the proposal to raise income assistance rates. His answer was that the Campbell government hasn't had enough credit for the raises it has already made. It looks like Coleman only took minutes to do to welfare what he took weeks to do to forestry.

And it looks like we are starting all over again.

Carole James on Axe the Tax

Gordon Campbell recently took 500 words in this paper to defend his new gas tax.
But I believe the premier's position can be summed up in 11 words: "I don't have to listen to you because I know better."
That's what led Mr. Campbell to develop his carbon tax in secret. That's why he refused to consult with anyone affected. And it's why he shut down debate and rammed it through the legislature.

Should we address climate change?
Absolutely. But the government must help provide alternatives. It shouldn't let big polluters off the hook. And it has to listen to people and develop consensus to move forward.
Gordon Campbell is doing none of that.

Then Carole says the following was written by a commentor on the petition she launched to "Axe the Tax"
"Sorry to those of you who live in the boondocks with big trucks to get around. Either find work that helps pay for your lifestyle, buy more fuel-efficient cars or move somewhere where you can work and ride transit like most British Columbians. Your lifestyles will be out of date soon enough, it's time to move on."
[Snip] .......

What kind of an utter moron could possibly write something like that. They obviously do not live in the north or the cariboo. They do not have a grasp of what life is like up here. They didn't even stop to think that for most of us there could be a half hour drive to the nearest town to get groceries, or gas, or a slurpy from 7/11. And let's not forget that many people from down there like myself, chose to retire up here nad we are on fixed incomes. Jesus christ man give your head a shake. I can only assume you are one of Gordon Campbells lackeys. No one in their right god damn mind, or at least in the know would make such a crass statement as that?

Carole goes on to say:

We won't deal with climate change by telling British Columbians they are "out of date."
Gordon Campbell's gas tax makes life harder and more expensive for average families.
The irony is that it does little to reduce global warming and climate change.
His own budget says fuel consumption will rise over the next few years.
In fact, if you peek behind the curtain, you'll see that the premier isn't so green.
While he hits you with a new gas tax, he's doling out hundreds of millions in subsidies to oil and gas companies to expand production.

As I have said before this tax is grossly unfair. I alledge we are paying to subsidize the corporate welfare being doled out in this province. And Campbell cannot possibly (if he is of sound mind) think that we are going to sit back and take this crap. I for one am not. Just wait till you hear what I did with my crummy hundred.

A Little Bit of Fairness goes a Long Way

Scrap the Fuel Tax, Provide Real Climate Action

Gas prices are skyrocketing and big oil companies are raking in record profits, but Gordon Campbell wants to hit consumers with another tax that will hardly make a difference in reducing greenhouse gases.


New Democrats believe that what we need to do is make big corporations pay for their pollution while providing tools to help ordinary people cut their fuel use, rather than hitting consumers with a tax at the pump while letting big polluters off the hook.


In the fight against climate change, Gordon Campbell has taken us in the wrong direction. His plan isn’t fair, it won’t work, and he’s not listening to British Columbians’ concerns.


New Democrats are committed to taking bold action on climate change. We’re building a comprehensive plan in consultation with British Columbians – a plan that enshrines the principles of fairness, openness, and effective environmental stewardship.

Now isn't this a little bit more fair to the consumer? All she needs to do now is have a law passed that says the industrial pollutors can't pass an inflated charge along to the consumers. Not too hard to do if you get a majority. Just look at how Campbell has screwed you and I with his majority.

An unholy alliance?

The following e-mail landed on my desk in a roundabout way. As I feel strongly about what is happening in this province I thought it may be a good thing to pass this on to anyone who may be reading my blog. The bottom line here is making the electorate aware who is paying the bills for our elected representatives. You can be sure if they are getting huge donations from certain places then their intersts will not be for the individual who elects them.


This also may not be such a bad idea for other areas of the province. It will give you an idea where your vote is going.

With strips of black cloth tied across our mouths, about 40 neighbours from around Vancouver sat through the two-hour City Council meeting last Tuesday afternoon, June 10th. We wore the black gags in protest of not being allowed to make oral presentations to the Council on the 'revised' version of their 'EcoDensity' Charter.





Before the meeting, we congregated outside expecting to talk to councillors as they entered the chambers. Neighbours from Norquay, Kitsilano, Shaughnessy, Point Grey, Arbutus, Kerrisdale, Trout Lake, Commercial Drive, Dunbar, Jericho Point Grey, and Collingwood, spoke about unwanted developments already begun in various neighbourhoods, about Council's abandonment of the vision committees, and about the need to continue the fight to stop mass rezoning.





Speakers called for the defeat of 'EcoDensity' and for the defeat of the very idea that densification, and not government action, brings a greener city, public and affordable housing, and services like public transit.City councillors entered the chambers through the back doors. And, after some unsuccessful ramblings about amendments to the document, without even a report on the many written submissions that were sent to Council, ALL the councillors voted to pass the so-called EcoDensity Charter.





What we have here is an astonishing alliance in favour of the pro-developer blueprint.Council voted unanimously in favour of a document that prescribes major densification of the city with no commitment to maintaining neighbourhood access to public services and green areas, no commitment to maintaining the availability of rental housing, no commitment to brokering the building of co-operative and public housing, no commitment to fulfilling Council's Olympic promises, no commitment to funding or providing the necessary staff for the continuation of the visioning process, and no commitment to seeking genuine neighbourhood approval for their major projects. It is a vote that renews Council's threat to mass rezone 18 Vancouver neighbourhoods in order to turn single family lots into lots for multi-condo structures, with the corresponding exodus of renters who lose their accommodation and homeowners who cannot pay the increased taxes. It is a vote to allow developers to fill ever more of our open spaces.This makes for a clear political picture. The decision of the Coalition Against 'EcoDensity' and for Liveability, to canvass those planning to run municipally this November, is now of paramount importance. It is crucial to publicize where each municipal candidate stands on rezoning and densification, on 'EcoDensity,' and on the laws that govern donations to candidates running municipally (many campaigns are developer-financed).Publicizing the developer-financed campaigns of those now in Council and of those running for Council is basic information our neighbourhoods must have, to make a democratic choice come next November. Our neighbourhoods must now more than ever take part in the electoral process, and be on the alert to fight every attempt to carry out their projected unscrupulous rezoning and densification anywhere in the city.

UBC Farm Under Threat of Developement

I received an E-mail from BC Mary regarding the the removal of part or parcel of the UBC farm for housing developement. Mary's time is pretty much consumed with the Legislature Raids and she asked if I could post this. You bet Mary. And this from Wendy Holm "post away".

The UBC Planning Process

Metro Vancouver documents state “The future of the Farm will be analyzed as part of the Vancouver Campus Plan process.” However within that process the Farm is being lumped under ‘future housing reserve’ and its value for the community is being downplayed.

◊ UBC has become known for its method of ‘presenting and defending’ its development plans during public consultation.

◊ The lands under consideration by the planning process are considered by the planning department to be ‘academic’ lands. However, the Farm is one of UBC’s major institutions for engaging the community.

◊ The planning process does not explicitly mention the UBC Farm. The only indication is in the legend on the map that states “The UBC Vancouver Campus plan will address the academic area, and the future housing reserve noted in the map.” However, the map does not locate the UBC Farm as being within that area.

◊ In the approved scope for the planning process, the Farm is simply lumped under “institutional components...south of 16th Ave.” with no mention to it individually.

◊ The Farm needs to be explicitly included as a unique institution within the current planning process, not just lumped in with playing fields and forest.

CN Rail case # 49026. We're still on.Rescheduled for 24Sep 2008

I guess it pays to keep on top of these things.

Yesterday morning June, 9, 2008 I checked the Court Docket for the North Vancouver Adult Provincial Court, and Case #49026. This case was on the Docket scheduled for 0930hrs. in Courtroom 2. I posted that fact below and went on with my day. Later in the day I made a comment on The Legislature Raids that this case was a go. Still later I read a piece at Bill Tieleman about some misinformation on an Appeal Court Hearing where we the public had been led to assume that we were not welcome at this hearing.

I don't know if it was alarm bells or what but I decided to recheck the NV Docket. Case #49026 had been scratched. It was no longer there. So I went to the "Completed List". Not there either. Then I noticed that June 9 Completed list had not been posted. So I figured I would wait until this morning.

On rechecking this morning I noticed it wasn't inder June, 10, so I proceeded to the Completed Court List. Voila. There it was.

There are five counts in this case. The first two are for Environmental Tickets. These are indicated as having been Paid Prior to a scheduled appearance.

The next appearance is for 24 Sep 2008 and this was Initiated by a Judge (IBJ) This is used when a Judge has determined that there is not enough time that day (for whatever reason) to hear this case.

The next hearing is listed as a Pretrial Conference (PTC) A Pretrial Conference is used when the Court requires the parties to attend a conference to discuss issues prior to commencement of a trial/hearing.

So, what this all tells me is that we are going to get more delays. Just like the Legislature Raids. This case will be 3 full years from the date of the disasterous spill in the Cheakamus River on August 5th 2005.

And there was a lot of footdragging in laying the charges. It wasn't intill the Squamish Nation threatened an immediate lawsuit that these charges were laid.

Here we go again. More Court Screwups

While reading some of my favourite blogs I stopped by Bill Tieleman and found that he discovered the following:

Every indication was that today's BC Court of Appeal hearing on the issue of whether a secret Crown witness should give testimony in the Basi-Virk case without the defence lawyers present would take place without the media or the public in the courtroom.

Then I decided to do some more DD. So I went to the Adult Completed Court List for the North Vancouver Provincial Court to check the disposition.

This morning after I checked the list for today and confirmed that Case #49026-1 was a go I posted it on this site. (see Below) So I went back there tonight to see what had happened. There was no completed list for today and I thought that's okay, someone will post it overnight. I'll check again in the morning.

Then I thought maybe I should go back and recheck the docket for today. POOOF. Gone. No listing for CN Rail on the docket. It was erased. All the other cases were there. I happen to know some of the participants. Lawyers as well as Judges and Defendants.

So today in BC we have two important cases in which information was incorrect. What happened? Why were we misled on the Appeal Trial within the Basi-Virk case? Why was the CN hearing scratched from the docket?

In the case of CN, was it that there was a last minute change?

I will be checking the North Van docket several times a day from now on. Was there anyone out there present in the North Van Court today?

Whistleblowers bc has some information for us

Following is a response to a comment I made over at Whistleblowers BC regarding some employees at our former BC Rail (now CN) coming under pressure not to discuss what I allege are matters of the utmost importance. Forgoing Safety in the name of profit. Any railroaders out there that feel threatened should pass this information along to others. In fact anyone in a workplace that feels threatened should heed this advise.

Following up on your comment on my blog, I'd advise the workers to keep good logs and copies of documents, e-mails etc. in a safe place away from home. There are many risks of blowing the whistle when corporate thugs are at the wheel. I don't know what union all of these folks belong to, is it Public Service Alliance, there is some federal Whistleblower language. I don't know if workers have some sort of "duty to report" safety issues in the federal juris-diction, but I hope the union's are working with the Trans-portation Safety Board around some of this stuff. The Board is the one investigating, they know things are going very, very poorly. I was at an event & some federal workers were talking about how everyone seems to be unclear about whether the WCB Act & regulations apply to federal employees. Too many damn places all of these people wriggle out of. Such a lack of accountability. Sometimes I feel like the world has been highjacked by these amoral Pod people, bent on making a buck any way they can, at anyone's expense. Don't any of these big corporate fascists have children? Do they think that just because they can afford private schools etc. that their kids won't deal with the ramifications of corporate greed, recklessness and irresponsibility? How much money is enough? I just don't get it. I think all of us in the blogosphere have to start doing some outreach to the employees of places like CN, invite them to blow the whistle publically (anonymously of course & without defaming anyone). Regime change isn't just for corporate and political fascists and revolution isn't just for communists. There are so many of "us" and so few of "them" there is a tipping point, we just have to find it and we will, by working together.

We're on...Case #49026-1

North Vancouver Courthouse this morning at 0930 hrs.

CN Rail is in court again this morning answering to environmental charges arriving from an August 2005 derailment that caused the death of over half a million fish in the Cheekamus River North of Squamish B.C. But what wasn't reported was the loss of countless other animals and birds. Birds such as the American Bald Eagle. This most majestic bird nests by the hundreds in this area. It would be very interesting to know just how many died as a result of this spill.

It is my understanding so far that when CN Rail took over our BC Rail suspicious things started to happen. Things like using prairie track in the mountainous areas of BC. A decrease in inspection of trucks (the wheels on the freight cars). Use of untrained personell for remote moving of locomotives in yards. And the biggest problem of all, the use of more cars in a train than allowed for, in these mountainous twisting areas.

It would be very interesting to know just what transpires in this case. Will the judge order a huge fine, or just slap their wrist? Will they be required to re-enhance the eco-system in the Cheekamus River Valley? Both would seem appropriate to me in this case.

So far I haven't been able to get any information from this case. The MSM is certainly not reporting much (if anything). So if anyone can get to the courthouse this morning we may be able to let others know what is going on here.

Laws, Fuel, Pharmacuticals, and You

A senior democratic senator in the US, Ted Kennedy, was recently struck by a cancerous Brain tumor. The price of fuel is going through the roof. Pharmaceutical companies are trying to get control of naturopathic medicines. Governments are trying to hop on the Green Wagon. Police are busting Grow-ops mainly because the are now easy to detect and are good for PR . This enables them to get more funds. And all of this can be fixed by legalizing hemp.(marijuana)

I have included both the hemp and marijuana words because they are one and the same. The word Marijuana was taken from a obscure Mexican slang word by none other than Randolph Hurst the US Newspaper publisher who was pissed at Pancho Villa for expropriating 800,000 acres of Hursts trees used for making newsprint.

Hurst then went on a personal campaign, using a method called "Yellow Journalism"
to make it illegal to have marijuana (hemp). He got the ear of a couple of mucky-mucks in the US government who lobbyed to have this plant outlawed.

The term medical marijuana took on dramatic new meaning in February, 2000 when researchers in Madrid announced they had destroyed incurable brain tumors in rats by injecting them with THC, the active ingredient in cannabis.
The Madrid study marks only the second time that THC has been administered to tumor-bearing animals; the first was a Virginia investigation 26 years ago. In both studies, the THC shrank or destroyed tumors in a majority of the test subjects.
Most Americans don't know anything about the Madrid discovery. Virtually no major U.S. newspapers carried the story, which ran only once on the AP and UPI news wires, on Feb. 29, 2000"
